    THAT Land Use Contract Discharge (LUC2020-001) Bylaw 1164, 2021 be read a third time.

    THAT the request for a three-month extension (until February 2, 2022) to Development Permit DP2019-23-C for 3118 Reimche Road, legally described as Lot 1, District Lot 169, ODYD, Plan 10040, be granted.

  • 2021-11-231 It was moved and seconded

    THAT the resolution for Development Permit DP2019-034-C for property located at 9960 and 9970 Bottom Wood Lake Road, legally described as Lots B and C District Lot 118 Osoyoos Division Yale District Plan EPP90725, Roll#2259162 and 2250163 be amended to state: 
    “AND FURTHER THAT the landscape security deposit of $432,241 be made a condition of the Development Permit to be fulfilled prior to the issuance of the Building Permit.”

Mario Russo

Mr. Russo addressed concerns regarding the water, noting that he is the only property owner that has developed any land. There is a massive aquifer under the area and clarified there is ample water. There has never been bussing up there. There has been garbage and road maintenance. Owners are providing wells and septic. The District is providing the roads. The District has all the means to say "no." The map seems to be unfair and this is why he brought it forward.

Mrs. and Mr. Madsen expressed disappointment that these are the only options presented to Council to choose from. There was discussion about changing the map to more of an access-based designation. The map is not equitable. There is no rhyme or reason for that. There has been very little movement up there. The map puts all the applicants in a bad situation. It has no merit on how it was developed other than the number of lots. Access is going to be the mitigating factor and 51 lots are not possible because of road frontage. Road frontage would not take much time of staff and would make the map equitable.

    THAT consideration of adoption of Moberly Local Service Area Repealing Bylaw 1163, 2021 be deferred to the next Regular Council Meeting pending communication of the proposed bylaws with the residents in the Moberly Local Service Area.

  • 2021-11-235 It was moved and seconded

    THAT Slope Stability Management Policy 191, 2021 be adopted;
    AND THAT Fire Hydrants (Water Systems) Inspection and Maintenance Policy 192, 2021 be adopted with the following amendment:

    That item 4 be updated to clarify private hydrants are not inspected or maintained by the District. Private hydrants are maintained under the requirements of the BC Fire code.

Councillor Scarrow announced December 9 the Christmas Bus comes through the District of Lake Country. There will be four or five stops, collecting money for local charities. they are looking towards a $60,000 to $70,000 target. Last year, with COVID-19 $25,000 worth of product was donated. It's a 10 day tour and if the DLC would support the Santa Bus when it comes, Councillor Scarrow would be appreciative.

Councillor McKenzie mentioned issues related to mental health are an ongoing concern and asked when Council will see Interior Health again to hear updates on overdose issues and COVID-19. It would be very valuable for Council to see them again at some point.

Councillor Gambell thanked the Fire Department for the wonderful fireworks display on Halloween. It was greatly appreciated. It was very special and brightened the whole evening. She thanked all those people and families of those that served in World War I and World War II and during peacekeeping for Canada. She also thanked those for their recent and continuing service through the COVID crisis; they are really putting themselves out there and we are fortunate to have people willing to do that.

Councillor Reed echoed Councillor Gambell's comments of thanks and encouraged people, if they cannot attend a remembrance day ceremony, to support your local legion and buy a poppy. 

Councillor Reed also advised that the Carr's Landing Recreation Association's AGM will be held tomorrow via Google Meet at 7 p.m. Invites can be accessed by contacting Wendy Malcomvist. Wendy also helped organize a social-distanced trick or treat and Councillor Reed thanked her and everyone that participated.

    THAT staff be directed to investigate bylaw amendments similar to other communities that consider blunting mechanism or alternative for spike fences to reduce the unnecessary suffering of wildlife.
